Investigation finds off-duty Mountain Brook officer not at fault in runner’s death

A jogger who was struck and killed by an off-duty Mountain Brook police officer on Jan. 31 was at fault, authorities said Monday.

Sundeep Caplash, 38, was struck from behind while he and a friend were jogging in the early morning hours on Montevallo Road.

Cpl. Steve Smith of the Alabama State Troopers, who assisted Mountain Brook police with the investigation, said Caplash was at fault for running with traffic rather than against, not wearing reflective clothing, and running in the street when a sidewalk was available.

 
Caplash, a husband and father, had been running for about nine months at the time he was killed. Smith said the findings of the investigation will be reviewed by the troopers’ traffic homicide coordinator and turned over to the Jefferson County District Attorney’s Office.
